WSSDA is recommending the update of two essential policies and the adoption of a third. The two revisions are relatively minor modifications.
Revised Policy 3220- Freedom of Expression: WSSDA has revised this model policy and procedure. The revisions clarify that prohibitions on student speech are limited to acts that "incite" rather than "advocate" the violation of the law. This clarification reflects the standard specified in the Washington New Voices Act (). Additionally, the U.S. Supreme Court has held that "incitement" is a different legal standard than advocate.
Revised Policy 5400-Personnel Leaves: WSSDA has revised this policy to provide the option of using unpaid leave for employees. We currently use unpaid leave in situations where employees are out of applicable leave and wish to take time off; in cases of classified employee discipline between when an employee is removed from service and when they are terminated; or more recently to respond to employees who were temporarily not qualified to work because of vaccination status.
New Policy 3411- Accommodating Students with Seizure Disorder or Epilepsy: directed WSSDA, in consultation with OSPI, to develop a model policy that school boards may use to meet the requirements for students with epilepsy or other seizure disorders.
